Indumar legal assistance insurance

Indumar legal assistance insurance is a product offered by insurance company Euromex.

Legal assistance insurance is an insurance whereby the insurer undertakes to provide services and incur costs (experts, lawyers, bailiffs, etc. ) in order to enable the insured to assert his/her rights, either as plaintiff or defendant, either in judicial, administrative or other proceedings or independently of any proceedings. The insurer assists the insured to reach an amicable solution to the dispute. The solution reached is always submitted to the insured.

Brief description of the coverages offered

We protect you and your family members from unexpected expenses in a legal dispute when you use your vessel. We also protect the owner of the vessel and those on board. More specifically, we cover:

Your freedom (criminal defense, assistance with interrogation in criminal investigations, ....).
Your physical integrity (injuries caused in a collision due to the fault of a third party, ....).
Recovery of damage to the vessel and fixed equipment caused by the fault of a third party (boating incident, vandalism, theft and the attempt to do so).
Disputes with administrative authorities (sailing license, flag registration, etc.).
Consumer law (contractual disputes with the other insurers of your vessel, purchase and sale, maintenance, storage, salvage, repair,....).
Third party insolvency (the person responsible for an accident is unable to pay the compensation awarded to you after the judgment).

Brief description of the major risks NOT covered by the insurance

Fines and settlements with the prosecutor's office.
Criminal defense for intentional violations.
Boating without a valid boating license.
A claim based on purchase-destroying defects in a purchase/sale agreement for vessels older than 10 years, unless the insured has a favorable expert report showing that the purchase-destroying defects were already present at the time of purchase.
Smuggling of goods and persons with the vessel.
The costs and fees of a lawyer or expert without our prior agreement. However, we may pay these costs or fees if they were incurred for urgent and emergency measures.

The maximum payment per dispute is € 200,000.00. For some guarantees, the insured amount is lower.

Legal information and complaints management

The insurance contract is governed by Belgian law.

Origin of the product developer: product offered by Euromex NV, Generaal Lemanstraat 82-92, 2600 Antwerp.

Location where you can get a quote together with a calculation of the premium: Indumar Insurance NV, Schoonzichtstraat 27, 9051 Ghent.

The term of the product is one year. After the end date, your policy will be tacitly renewed for one year at a time, unless you (notice period of 2 months) or we (notice period of 3 months) cancel the policy by registered mail, by bailiff's writ or by delivery of the termination letter against receipt, subject to compliance with the aforementioned notice period.
If you are a consumer, you can terminate the tacitly renewable contracts without any costs or penalties after the expiry of a period of one year from the start of the insurance contract. The termination shall take effect after the expiry of a period of two months.

Any complaint regarding this offer or the insurance contract can be addressed to the internal complaints department Indumar Insurance NV, Schoonzichtstraat 27, 9051 Ghent, info@indumar.be.

If you disagree with the outcome of the complaint handling, you can submit a complaint to the VZW Insurance Ombudsman, square de Meeûs 35, 1000 Brussels Tel No: 02/ 547 58 71; Fax No: 02/ 547 59 75; info@ombudsman-insurance.be ; www.ombudsman-insurance.be. Complaints must be submitted in writing. Submitting a complaint does not affect the policyholder's right to take legal action.
